Terms of Service

These Terms of Service ("Terms") form a legal agreement between you ("User," "you," or "your") and Sterling Mind ("Company," "we," "us," or "our"). By downloading, installing, accessing, or using the ADHD Mind application ("App"), you agree to be bound by these Terms.

Sterling Mind is the business name used to operate the ADHD Mind app. References to "Company," "we," "us," and "our" in these Terms refer to the operator of Sterling Mind.

If you do not agree with any part of these Terms, you may not use the App. We reserve the right to update these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

1. Agreement to Terms

By using ADHD Mind, you acknowledge that you:

• Have read and understood these Terms of Service and our Privacy Policy
• Are at least 18 years old
• Are legally capable of entering into a binding contract
• Have the authority to bind yourself to these Terms
• Accept all terms, conditions, and obligations contained herein

2. Description of Service

ADHD Mind is a digital wellness and self-care application that provides:

• A 6-week daily hypnotherapy program targeting ADHD nervous system patterns
• Structured audio sessions (15-20 minutes per day) using hypnotherapy techniques
• Daily pattern insights, breathwork, and self-assessment tools
• Progress tracking and personalized content
• An Emergency Toolkit of 10 on-demand ~20-minute full clinical sessions for immediate support

What ADHD Mind Is NOT

• Not a medical device or medical treatment
• Not a substitute for professional therapy, counseling, or psychiatric care
• Not a diagnostic tool for ADHD or any other condition
• Not intended to cure, treat, or prevent ADHD or mental health conditions

3. Subscription & Billing (Auto-Renewing Subscriptions via Apple App Store)

ADHD Mind subscriptions are sold and billed through the Apple App Store. By purchasing a subscription, you agree to the terms below, which are required by Apple for all auto-renewing subscriptions offered on iOS.

Subscription Title & Pricing Tiers

ADHD Mind offers the following subscription options. Prices shown are in U.S. dollars and may be converted to your local currency at checkout by the App Store. Prices in other regions may vary based on Apple's price tier matrix, local taxes, and exchange rates.

• ADHD Mind Monthly: $14.99 USD per 1-month period, auto-renewing
• ADHD Mind Annual: $99.00 USD per 12-month period, auto-renewing (approximately $8.25/month)

Payment & Auto-Renewal

By purchasing an auto-renewing subscription (Monthly or Annual), you acknowledge and agree that:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period, at the subscription price listed above (or the then-current price for your region).
• Subscriptions may be managed by the user, and auto-renewal may be turned off by the user, by going to the user's Account Settings on the device after purchase.
• No cancellation of the current subscription is allowed during the active subscription period.

Cancellation & Turning Off Auto-Renewal

You may turn off auto-renewal at any time. To do so on your iOS device, open Settings → [your name] → Subscriptions, select ADHD Mind, and tap Cancel Subscription. You may also manage your subscriptions in your App Store account. Cancellation takes effect at the end of the current billing period; you will retain access until that date. Because billing is handled by Apple, ADHD Mind (Sterling Mind) cannot cancel your subscription on your behalf.

Billing Disputes & Refund Requests

All subscription purchases are processed by Apple. Refund requests for App Store purchases must be submitted to Apple through reportaproblem.apple.com, in accordance with Apple's refund policies. For questions about your ADHD Mind account (not billing), contact us at support@adhdmind.app.

Privacy Policy & Terms of Use

Your use of ADHD Mind is governed by these Terms of Use and our Privacy Policy. Apple is not responsible for the content of the App or for providing any required maintenance or support.

4. Free Trial

New users may be eligible for a 2-week (14-day) free trial of ADHD Mind's auto-renewing subscription, offered at Apple's discretion and subject to Apple's Introductory Offer rules. During the trial:

• You have full access to Week 1 content (The Wiring), all of Week 2 (The Shame Layer, days 8–14), and the Emergency Toolkit.
• Your trial period begins when you redeem the offer through the App Store.
• If you do not cancel at least 24 hours before the trial ends, your chosen subscription plan will automatically begin and your Apple ID account will be charged the subscription price shown at purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to ADHD Mind, where applicable.

You can cancel anytime during the trial period without charge by turning off auto-renewal in Settings → [your name] → Subscriptions on your iOS device.

5. Refund Policy

All ADHD Mind subscription purchases are processed by the Apple App Store. Refund eligibility, approval, and processing are handled by Apple in accordance with Apple's Media Services Terms and Conditions and applicable law in your region.

How to Request a Refund

To request a refund for an ADHD Mind subscription, visit reportaproblem.apple.com and follow Apple's instructions, or go to Settings → [your name] → Media & Purchases → View Account → Purchase History on your iOS device. Apple will evaluate and process eligible refund requests.

ADHD Mind (Sterling Mind) cannot issue or process refunds for App Store purchases directly. If you need help with your account (separate from billing), contact us at support@adhdmind.app and we will do what we can to assist.

Statutory Consumer Rights

Nothing in this section limits any non-waivable consumer rights you may have under the laws of your jurisdiction (including, where applicable, the right to withdraw from a digital content purchase within 14 days in the European Union and United Kingdom, unless you have expressly consented to immediate delivery and waived that right at checkout).

6. Medical Disclaimer

CRITICAL: ADHD Mind is NOT medical treatment, therapy, or medical advice.

• The App is a self-care and wellness tool only
• Hypnotherapy provided in the App does not replace professional psychiatric or psychological care
• Assessment data is for self-awareness—not clinical diagnosis or medical records
• We do not diagnose, treat, cure, or prevent ADHD or any other condition

Professional Care

If you have ADHD, mental health concerns, or are in crisis:

• Consult a qualified healthcare provider (psychiatrist, psychologist, therapist)
• Never use ADHD Mind as a substitute for professional care
• If you are in a mental-health crisis, contact your local emergency services or visit findahelpline.com

Use Restrictions

Do NOT use ADHD Mind:

• While driving, operating machinery, or in situations requiring alertness
• If you are pregnant or nursing (consult your healthcare provider first)
• If you have a history of psychosis or severe mental illness (without professional guidance)
• In place of emergency medical care

7. User Responsibilities

You agree to:

• Use ADHD Mind only for lawful, personal purposes
• Provide accurate account information and keep it updated
• Maintain the confidentiality of your password and account
• Notify us immediately of unauthorized access to your account
• Comply with all applicable laws and regulations
• Not share your account with others or use multiple accounts to exploit free trials or refund policies

You agree NOT to:

• Copy, modify, or reverse-engineer the App or any of its content
• Use the App for commercial purposes without written permission
• Attempt to access the App's servers or bypass security measures
• Use the App to harass, defame, or harm others
• Share, distribute, or reproduce copyrighted content from the App

8. Intellectual Property

Ownership

All content in ADHD Mind—including hypnotherapy sessions, audio scripts, educational materials, graphics, logos, and designs—is the exclusive intellectual property of Sterling Mind and protected by copyright law.

License to Use

By purchasing a subscription, you receive a limited, non-exclusive, non-transferable license to use the App and its content for personal, non-commercial use only. This license does not grant you ownership of the App or any of its content.

Prohibited Uses

You may not:

• Reproduce, distribute, or publish any content from the App without permission
• Create derivative works based on ADHD Mind content
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App's content in commercial products or services

User Feedback

Any feedback, suggestions, or ideas you provide about ADHD Mind may be used by us without compensation or attribution. We appreciate your input and may incorporate it into future versions of the App.

9. Limitation of Liability

DISCLAIMER: ADHD Mind is provided "AS IS" without warranties of any kind, express or implied.

No Guarantees

We do not guarantee that:

• The App will be error-free or uninterrupted
• Any particular results will be achieved from using the App
• The App is suitable for your specific condition or needs
• Your data will never be lost or compromised

Limitation of Damages

To the maximum extent permitted by law, Sterling Mind shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of income, profits, or business opportunity
• Damages arising from your use or inability to use the App
• Results (or lack thereof) from using ADHD Mind
• Data loss or security breaches (except in cases of our gross negligence)

Our total liability to you shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

10. Termination

By You

You may terminate your account at any time by:

• Deleting the App from your device
• Requesting account deletion through App settings or email (privacy@adhdmind.app)

Upon deletion, your account and personal data will be removed within 30 days.

By Us

We may terminate or suspend your account immediately without notice if you:

• Violate these Terms of Service
• Use the App unlawfully or for harmful purposes
• Engage in fraudulent activity (e.g., exploiting refunds or free trials)
• Attempt to hack, reverse-engineer, or breach the App's security
• Harass, abuse, or threaten our team or other users

Effect of Termination

Upon termination:

• Your license to use the App immediately ceases
• You lose access to all subscription content and your account data
• No refunds will be issued for remaining subscription time (unless otherwise required by law)
• Our obligations to you end, except where survival is required by these Terms

11. Changes to Terms

We may update these Terms of Service at any time. We will notify you of material changes by:

• Updating the "Last updated" date at the top of this page
• Sending you a notification through the App or email (if required by law)
• Requiring your acceptance of the new Terms before continued use

Your continued use of ADHD Mind after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with any changes, you must discontinue use of the App.

12. Governing Law & Jurisdiction

These Terms of Service are governed by the laws of the United States, without regard to its conflict of law principles. Any legal action or proceeding arising from these Terms shall be brought exclusively in the federal or state courts located in the United States, and you consent to the jurisdiction and venue of such courts.

13. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Sterling Mind regarding your use of ADHD Mind. They supersede all prior agreements, whether written or oral. If any provision is found to be unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force.
